2. Introduction

As part of the Company’s digital transformation, Elior Group would like to help its employees have a better command of social networks. In order to facilitate their understanding of digital technology and give them the pointers they need for using such networks, it has launched a project called #WeAreSocializers as well as a website called wearesocializers.eliorgroup.com. Part of this website is public, i.e. accessible to everyone, and part is private, accessible only to employees of Group Companies (as defined below). 

 

3. Terms and Conditions of Use of the Site

This website (hereinafter “the Site”) is the property of Elior Group (hereinafter “the Site Publisher”). By using the Site you agree to be bound by and comply with these Terms and Conditions of Use.

In accordance with Article 3.9 below, “Updates to the Terms and Conditions of Use of the Site”, users are advised to refer to the most recent version of said terms and conditions.

 

3.1 Definitions 

In accordance with Article 2 of the French Data Protection Act (Loi Informatique et Libertés), “Personal Data” means data concerning an identified individual person or data that enables an individual person to be identified directly or indirectly by way of an identification number or by reference to one or more details that are specific to said person. No “sensitive” personal data (e.g. information related to ethnic origin, political, philosophical or religious opinions, trade union membership or lifestyle) is collected via the Site.

“Group Company(ies)” means either (i) all of the companies of the Elior group, i.e. all companies that are directly or indirectly controlled or jointly controlled by the Site Publisher or that directly or indirectly control the Site Publisher (within the meaning of Article L233-3 of the French Commercial Code), or (ii) any one of the companies of the Elior group when it is not necessary to specifically identify that company. Each Group Company has its own separate legal existence and personality, and consequently the use of the term “Group Companies” does not constitute evidence of the formation between the said companies of a grouping with joint and several liability, either with respect to the Users of the Site or more generally any third party.

“Site” means all of the web content and related resources published by the Site Publisher or a Group Company and which can be accessed via the wearesocializers.eliorgroup.com internet address.

“Information” means all information obtained from the questionnaire as well as all other content available on the Site (both informational and non-informational) that is accessible to the public or, concerning the private section of the Site, that is accessible with a login and a password. 

“Services” means services provided by the Site Publisher or Group Companies. Said Services may result from accessing either the public or private sections of the Site. 

“You” or the “User” means any visitor to the Site, irrespective of whether or not it is for business purposes or whether they they are customers of the Site Publisher.

 

3.2 Methods of Use

The Site Publisher has put the Site on line in order to enable You to access, publicly and with no registration requirement, a questionnaire which is used to identify You in relation to the project described in Article 2 above, “Introduction”. 

The Site also enables the Site Publisher to offer other services, via a private access, and notably the opportunity to participate in conferences. The private section of the Site is exclusively reserved for employees of Group Companies. The Site Publisher, and more generally, the Group Companies therefore reserve the right to refuse access to the private section of the Site and the content thereof to any person who is not an employee of a Group Company and to refuse to allow any such person to take part in the conferences organized by Group Companies as part of the project described in Article 2 above, “Introduction”.

The Site Publisher may propose other services via the Site, in which case You will be required to accept the specific Terms and Conditions of Use relating thereto before using such services. In such a case the new Terms and Conditions of Use of said other services will apply in addition to these Terms and Conditions of the Site.  

If You wish to receive Services available on the private section of the Site, You will be required to register and complete the registration/contact form provided for that purpose. Once you have filled out this form you will receive an email confirming that your registration has been successful. 

A confirmation e-mail will also be sent to the e-mail address given when You register and/or state an interest in taking part in a conference offered on the Site. 

 

Hyperlinks

Hyperlinks to content contained on the Site may be created subject to the following two conditions:

  • Deep linking (framing) is prohibited. Consequently no content featured on a page of the Site may be published on, transferred to or inserted into another website, in whole or in part, or be used to create related products. 
  • The Site must be cited as the source of the content concerned.

 

3.3 Information Available on the Site

The Site Publisher will use its best efforts to provide You with information that is accurate and complete as at the time You access it. However, if you are aware of any information that is incorrect or incomplete You may request that such information be rectified or updated. Such requests should be addressed to:

3.4 Cookies

Cookies are small text files that are sent to your computer by a website server and stored in a “cookies” folder. Information about your browsing on the Site may be stored in this folder and used to help You access the Site and improve your browsing experience.

You can block cookies or disenable them for all or some websites by changing your web browser’s settings. Please refer to the user manual for your web browser and/or computer for information on how to do this.

 

3.5 Social Networks

The Site uses IT applications provided by third parties in the form of social sharing buttons (particularly “Share” buttons on social networks), which enable Users to share with third parties the Site’s content – notably the results of the questionnaire or Information on the project described in Article 2 above – or to inform third parties of their opinion of the Site’s content. 

When You use the Site once You have filled out the questionnaire or when You visit a page on the Site, if You click on the social sharing button, then a direct connection is established with the servers of the social network concerned, enabling data to be transmitted to the social network and published on your account. 

If You do not want the social network to link the information obtained through the Site to your account you should log out of the social network before visiting the Site. 

The social sharing buttons are subject to the confidentiality and privacy policies of the relevant social networks, which Users should refer to for information on the end-uses of the social sharing buttons. 

 

3.6 Intellectual Property 

The Site Publisher and/or Group Companies hold all of the intellectual property rights related to the content available on the Site (brands, slogans, logos, etc.) or hold all the required licenses to use such content.

The Site Publisher and/or Group Companies is/are the author(s) of the Site within the meaning of Article L. 111.1 of the French Intellectual Property Code.

Access to the Site does not confer upon You any intellectual property rights related to the Site, which remain exclusively owned by the Site Publisher and/or Group Companies or their partners. 

All of the content available on the Site, notably written text, photographs, slogans, drawings, images, icons, sound, videos, software, animated sequences (with or without audio), databases and, more generally, any and all intellectual creations, are also protected by intellectual and industrial property rights as well as other private rights that the Site Publisher and/or Group Companies or their partners hold.

You may not in any circumstances or in any way reproduce, represent, modify, transmit, publish or adapt – on any current or future media – or in any way exploit the material or content of all or part of the Site without the prior written consent of the Site Publisher. 

The corporate names, brands and other distinctive signs reproduced on the Site are protected under trademark law and have been registered with the relevant organizations (INPI, EUIPO, OMPI). 

Any exploitation of the material or content of the Site for any purpose, without the prior authorization of the Site Publisher, may result in legal action, notably for infringement within the meaning of Article L.335-2 et seq. of the French Commercial Code and for compensation for any losses suffered. 

 

3.7 Personal Data – Registration Data

Whether You access the public or private section of the Site You may be asked to provide information that constitutes Personal Data. 

When You register on the Site You undertake to provide true, accurate, up-to-date and full information about yourself. 

Registration data and any other personal information collected via the forms used for contact details, personalized services or other types of questions is automatically processed in accordance with the French Data Protection Act (Act 78-17 dated January 6, 1978) and a declaration related to such processing is lodged with the CNIL (French Data Protection Agency). 

Personal Data is intended for the sole use of the Site Publisher and or the Site host or Group Companies and will not be communicated to any third party.

Personal Data may also be collected for the purpose of creating your account in order to access the private section of the Site, which is reserved for employees of Group Companies, as well as for signing up  for conferences. 

Users are hereby informed that certain Information is compulsory. If such Information is not input or is input incorrectly, it will not be transmitted.

3.8 Limitation of Liability 

Users acknowledge that the use of or reliance on any Information published on the Site is entirely at their own risk and responsibility. Such Information may in no circumstances constitute any form of contractual documentation.

Neither the Site Publisher nor any other Group Company may be held liable for any direct and/or indirect loss or damage, irrespective of the nature or consequences thereof, resulting from (i) the use of said Information and/or (ii) any inability to access said Information or the Site as a whole.

More generally, neither the Site Publisher nor any other Group Company may be held liable for any direct and/or indirect loss or damage resulting from the use of the Site and/or from the presence of a computer virus on the Site, including any loss of data and/or any financial loss that may result from logging on to the Site or using the Information. Users are responsible for protecting their own hardware and for the use that they make of the Information published on the Site.

The Site Publisher does not accept any form of liability with respect to the content of any websites to which links may be provided on the Site. Such links are proposed as a service and You are solely responsible for deciding whether or not to use them.

 

3.9 Updates to the Terms and Conditions of Use of the Site

The Site Publisher reserves the right to add to, amend, correct and/or delete any content on the Site, either permanently or temporarily, and to update these Terms and Conditions of Use, at any time and without notice. Consequently, you should read the Terms and Conditions of Use regularly to verify if any changes have been made.

 

3.10 Governing Law and Dispute Resolution 

These Terms and Conditions of Use are subject to French law. 

Any Users who log on to the Site from countries other than France must ensure that they comply with the laws applicable in those countries.

Any disputes relating to the interpretation and/or application of these Terms and Conditions shall be referred to the competent courts within the remit of the Versailles Court of Appeal.
